Constitutional safeguards - yay!

    One of the very few benefits we received from Bill Clinton's presidency was increased awareness of  constitutional law.  So it is that I was prepared for John Kerry's short list of vice-presidential hugger-muggers, as presented by CNN. Among them - and a finer group of scoundrels are seldom found in one room - we find:

Few vice-presidential possibilities boast the accomplished resume -- or political baggage -- of former President Bill Clinton. Clinton studied at Georgetown, Yale and Oxford (as a Rhodes scholar) before returning to his home state of Arkansas. He taught at the University of Arkansas' law school for three years before, at 30, being elected the state's attorney general. Clinton later served six terms as Arkansas' governor (he won in 1978, lost a 1980 race, then was re-elected two years later), before defeating incumbent George H.W. Bush to become U.S. president, starting in January 1993. While federal law prohibits a person from seeking a third presidential term, the Constitution does not specify whether or not a former commander in chief can become vice president. "
   As a constitutional scholar,  I also know that  "no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States." [12th Amendment]  I also know that John Kerry himself is constitutionally proscribed by Amendment 14, Sec. III  from being president, so why are we being tortured with this farging campaign?

OK, here is Section 3: Section. 3. No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

I suppose the "aid and comfort to the enemies" portion is applicable. Congress may remove the disability with a two thirds vote in each house. I suggest, therefore, that some impish Republican introduce legislation to remove the disability, in the spirit of bipartisanship. To make sure he can run, despite his aid and comfort to the enemy. He'll run anyway, but the Republicans can have fun with this one.

It's all about HIM (and his unholy queen). They will challenge anyone and any law to stay in the limelight and continue to retain political power.

The radio show host Mark Larson mentioned this yesterday and I called in to note that it violated the 12th Amendment. He was reading the same article but had not come across the legal rebuttal yet.

I do not why I still get amazed at the outright ignorance of the media, but this really struck me. That CNN does not know the Amendments is frightening. Do you not love how they stated it so forthrightly and with no room for doubt?

But it does. So sad.

But..but...but Rodge, don't you realize the Constitution is a living document? Good God it states that to be vice president, you have to be eligible to be president which Clinton is not! Heven't these fuckheads ever read the Constitution? Sorry. I lost my head. Of course they haven't. They were too busy being taught self esteem when they went to school. Asstards!

I read section 14 and I don't see how it prevents the guy form running. I don't think the spirit of the law is such as it would include nonviolent protest in the definition of "insurrection or rebellion" - that would indicated armed conflict or conspiracy!
