Berger is benefitting from the fact that the reporters doing this story haven't had to handle classified before. Everyone with a clearance, including Berger, knows:

1. No document may be removed from a classified vault without permission (and logging) of the classification authority.

2. Classified documents may never be removed from the vault, except as above.

3. Any notes Berger took while in the vault are themselves classified and must remain in the vault as well. He would need permission to bring them out.

He not only didn't ask for such permission, he secreted documents, even originals, on his person. He took them out of the vault knowing that was not permitted, and also took his notes, likewise not permitted.

There is no way Berger was unaware of the rules, and the fact that he hid the material on his person shows he knew it was wrong.

Berger has also apparently "lost" a couple of original documents. Since his other actions were knowing and intentional, we must presume he intended to "lose" the documents as well. I don't know what was on them, and I hope there are copies, but they may well have contained information damaging to him and the Clinton administration.

By the way, the term vault may sound like a small place where a bank stores money. Not so here. It is a secure enclosure with stored documents and tables, chairs, and other space for people to work with classified documents and hold classified conversations. It can be pretty large.

Ergo, the media all but ignores this story. To whit, the Boston Globe {SPIT}'s take is that the timing of the story breaking is suspicious.

Not that Berger should be in fucking jail.

Not that this POS destroyed documents that might help us in the war on terror.
